Legal Advisory Warns of Deepening ADC Leadership Crisis, Urges Urgent Internal Resolution

A fresh legal advisory has raised concerns over a worsening leadership crisis within the African Democratic Congress (ADC), warning that the party currently faces a “national leadership vacuum” amid ongoing disputes and lack of recognition by the electoral body.

The memorandum, dated April 20, 2026, and addressed to key party stakeholders including former Senate President David Mark and former Osun State governor Rauf Aregbesola, stated that the Independent National Electoral Commission (INEC) has continued to withhold recognition from all factions of the party.

According to the advisory, INEC has listed the party’s leadership status as “by court order” and is currently refusing to monitor congresses, accept official correspondence, or engage with any faction until pending legal disputes are resolved.

Court Developments

The memo highlighted recent judicial developments, noting that the Supreme Court has granted an accelerated hearing in an appeal filed by the Mark-led faction, with proceedings scheduled for April 22, 2026. However, the court declined to grant a stay of proceedings.

It also referenced a Federal High Court order directing all parties to maintain the status quo at the state level, effectively protecting existing state executive committees from alteration pending final determination of the case.

Questions Over Legality of Party Actions

The advisory raised concerns over recent actions by the Mark-led National Working Committee (NWC), including statewide congresses and a national convention reportedly held on April 14.

It argued that these actions may be legally questionable, citing potential violations of provisions of the Electoral Act requiring prior notice to INEC, as well as possible breaches of existing court orders. The memo warned that outcomes from such activities risk being declared invalid.

Call for Immediate Internal Action

The legal adviser urged party leaders to pursue internal resolution mechanisms rather than rely solely on court outcomes. Key recommendations include:

  • Convening an emergency National Executive Committee (NEC) meeting through the support of two-thirds of members
  • Ensuring compliance with statutory requirements, including proper notification to INEC
  • Filling leadership vacancies in line with the party’s constitution on an interim basis

The memo also called on Rabiu Musa Kwankwaso to use his influence to help mobilize party leaders toward a unified resolution.

Push for Unity Ahead of 2027

The advisory further recommended suspending factional activities, encouraging consultations among state chairmen, and focusing on party unity and preparations for the 2027 general elections.

It concluded by emphasizing that the ADC’s future depends on internal cohesion and lawful processes, warning that prolonged divisions could undermine the party’s viability as a political force.
