Lagos socialite and businessman Afolabi Kazeem, popularly known as KC Luxury, has challenged the National Drug Law Enforcement Agency (NDLEA) in court over his continued detention following his arrest earlier this month.
KC Luxury filed a fundamental rights enforcement suit before the Federal High Court in Lagos, asking the court to declare his continued detention without a formal criminal charge unlawful.
Through his lawyer, Abdulakeem Labi-Lawal, SAN, the businessman is seeking ₦190 million in damages. He is also asking the court to order his immediate release or grant him bail pending the filing of any criminal charge.
KC Luxury was arrested by NDLEA operatives on August 13, 2026, at the Murtala Muhammed International Airport in Lagos while reportedly preparing to travel to Paris. The agency subsequently linked the arrest to an investigation involving the seizure of 184.5 kilogrammes of cocaine.
NDLEA Chairman Brigadier-General Mohamed Buba Marwa had described KC Luxury as an alleged cartel leader and claimed he was attempting to leave Nigeria when he was arrested.
However, KC Luxury has disputed aspects of the agency’s handling of his case. In an affidavit filed in support of his application, his father, Eric Afolabi, alleged that his son had spent 14 days in custody without being formally charged or informed of the specific offence for which he was being detained.
The family also alleged that NDLEA operatives searched KC Luxury’s residence in Banana Island without presenting a search warrant and claimed that no incriminating material was recovered.
The suit further challenges the alleged publication of photographs and videos of KC Luxury while in custody, which he argues infringed on his privacy and reputation.
Justice Friday Ogazi declined to grant the application without hearing from the NDLEA. The judge directed the agency to respond and ordered that KC Luxury be produced in court at the next hearing.
The case has been adjourned until September 9, 2026.
The allegations against KC Luxury remain before the court and have not been determined. The NDLEA’s investigation and the legal challenge will now proceed through the judicial process.
