A legal challenge has been instituted at the ECOWAS Court of Justice questioning Nigeria’s long-standing requirement that candidates for elective office must be sponsored by political parties.
The case, filed by Professor Amos Enabulele, an expert in international law, alongside the Centre for Community Court, seeks to test the legality of the provision under Nigeria’s electoral framework.
Since 1999, Nigeria’s electoral laws have effectively excluded independent candidates by mandating political party sponsorship for anyone seeking public office. While the policy has remained in place for over two decades, it has not been subjected to a definitive legal challenge until now.
The applicants argue that the restriction raises constitutional and democratic concerns, particularly around citizens’ rights to political participation and representation.
The move comes at a time when several opposition parties are facing internal crises ahead of the 2027 general elections, prompting renewed debate about the inclusiveness of Nigeria’s political system.
The outcome of the case at the ECOWAS Court is expected to have significant implications for electoral reforms and the future of independent candidacy in Nigeria.
