Dr. Von Batten has formally commenced a $26 million defamation lawsuit against SaharaReporters Media Group, Inc. and Ademola Bello, filing the case before the United States District Court for the District of Columbia.
In a statement announcing the development, Von Batten said he personally filed the suit on Tuesday morning and identified the case as Von Batten v. Sahara Reporters Media Group, Inc., et al., Case No. 1:26-cv-03209.
According to the statement, Von Batten is proceeding pro se at the present stage of the litigation, while receiving support from an independent legal team as the case progresses. He said the action seeks $26 million in damages over allegations contained in publications and materials which he considers false and defamatory.
Von Batten said the filing marks a shift from the ongoing public exchanges surrounding the controversy to a formal judicial process, where the allegations and evidence can be examined under the procedures of a US federal court.
A major focus of the proposed litigation, according to the statement, will be discovery. Von Batten said he intends to seek evidence relating to what he characterises as a coordinated smear campaign allegedly designed to frustrate his efforts to obtain the public release of records from the FBI and Drug Enforcement Administration (DEA) concerning allegations of drug trafficking involving Nigerian President Bola Ahmed Tinubu.
The allegations concerning Tinubu remain allegations and should not be treated as established facts unless proven through competent evidence or official proceedings. Likewise, the filing of a defamation lawsuit does not itself establish that the publications complained of were defamatory or that the defendants are liable. The defendants will have an opportunity to respond to the claims in court.
Von Batten further stated that he could pursue additional legal action against other individuals or entities if evidence obtained during the proceedings establishes that they participated in planning, organising, financing or otherwise facilitating what he describes as the alleged smear campaign.

Von Batten and SaharaReporters, particularly if the discovery process produces evidence concerning the sourcing, preparation, financing or dissemination of the contested allegations.
The development also places the wider controversy involving alleged FBI and DEA records relating to Tinubu before a US judicial forum. Any such records, their contents and their legal status would ultimately have to be established through admissible evidence and the applicable court processes rather than through competing claims on social media.
Von Batten ended his announcement by tagging several senior US officials, congressional committees and US government agencies, including the White House, Department of State, Department of Justice, FBI and DEA, as well as major American media organisations, signalling the international and political significance he attaches to the litigation.
