A federal judge in the United States has overturned a Trump administration policy that suspended immigrant visa processing for nationals of 75 countries, including Nigeria.
The ruling by US District Judge Jeannette Vargas in Manhattan represents a setback for the administration’s efforts to tighten legal immigration and could provide relief for Nigerians and other affected applicants seeking to settle permanently in the United States.
The disputed policy was introduced by the US State Department in January under Secretary of State Marco Rubio. It halted the processing of immigrant visa applications from the affected countries over concerns that some applicants could become dependent on government assistance after arriving in the United States.
However, Judge Vargas ruled that the policy went beyond the authority granted to the secretary of state under US immigration law. She described the measure as “patently unlawful” and said a blanket restriction based on nationality conflicted with the legal framework governing immigrant visa decisions.
The lawsuit that led to the ruling was filed by immigrant rights organisations, visa applicants and US citizens sponsoring relatives from affected countries. The plaintiffs challenged the government’s decision to suspend processing across entire nationalities rather than assess applications individually.
The decision is particularly important for Nigerians with family-based, employment-based and other immigrant visa applications. It could reopen a pathway that had been disrupted by the January suspension, although the practical effect of the ruling may depend on how the US government responds and whether it pursues further legal action.
The ruling does not remove every immigration restriction introduced by the Trump administration. Other visa and travel measures remain subject to separate policies and court proceedings.
The 75-country suspension was part of a broader immigration agenda focused on reducing legal and illegal migration. The latest judgment adds to a series of legal challenges confronting the administration’s immigration policies and highlights the continuing role of US courts in determining the limits of executive authority.
